2. BESTILLING OG BETALING
www.Embacco.dk is open round the clock, hence you will nearly always be able to make purchases. There are, however, occasions where we close the shop for maintenance. You can only make purchases when the shop is open and available. In order to make purchases at www.embacco.dk you must be at least 18 years of age and have a valid payment card that we accept. If you have not turned 18 yet, you can still purchase goods if you have obtained your guardian’s consent or otherwise have the legal right to make the purchase. You simply select the goods you wish to purchase and place them in the ‘shopping cart’. You can correct the contents of the shopping cart up to the point when you actually place the order, and you can review its contents and the prices for the goods on a running basis. Any possible extra payments, for example for freight and payment card fees will only first be calculated immediately before you are ready to pay. When you are ready to place the order, click on ‘ORDER’, where you enter your name, address, email, telephone number, form of payment and choose the form of delivery. You can change the content of the shopping cart all the way up to when you confirm your purchase by pressing the button ‘TO PAYMENT’. Your order is then transmitted to www. Embacco.dk

Embacco is a Danish merchant, and therefore some cards can be charged a small fee for making purchases at an international merchant. This is a charge levied by the card issuer NOT by Embacco. Some banks only charge if a foreign currency is being used – i.e. a FX charge is charged. However, this depends upon the issuer themselves. The data you submit in connection with purchases paid with by credit card is encrypted (SSL(Secure Socket Layer). Neither Embacco or others have the opportunity to read the data you provide. All prices are in Euro and incl. 25% VAT and all Danish duties, customs, etc. We reserve the right for price and typing
errors.
4. DELIVERY
All deliveries must be signed for when receiving them. It does not need to be you yourself who signs for it. It could be another person at the same address (for example, a family member) or a neighbor who signs the receipt for the package. We use GLS as our delivery partner. Delivery time for our products Outdoor lamps (5-10 days) FAB (3-4 weeks) If GLS does not meet any recipient on the delivery-address, GLS will deliver the item to be picked up in a GLS package shop (pick-up within 10 working days) , and GLS will notify the recipient of pick-up location. Alternatively GLS will return the package to a GLS depot, and ask the receiver to contact GLS for a new delivery attempt or pick-up location in a GLS depot, as GLS otherwise will return the shipment to DYBERGKERN after 10 working days.
5. RECEIPT
You are responsible for those products that you have ordered once the delivery has been carried out. If the package appears to be damaged, we ask that you refuse to take delivery of it. You are responsible for examining your goods for any possible defects and for notifying us of any possible defects in
them. If it turns out that one or more of the goods are defective, or an item is missing from the delivery, or one or more things are incorrect in relation to your order, then you have the possibility to return your defective goods, and we then will repay the purchase price and all delivery costs. 6. RETURNS or WITHDRAWAL
When you make a purchase on the web and at www.embacco.dk you normally have a 14-day right to change your mind, during which you can notify us that you are withdrawing from the purchase and then return the goods concerned to us. Some goods are not encompassed by the right of withdrawal, and this will appear during the course of the ordering. In the event there are several different goods that have been ordered together in one order, but which have been delivered individually, or a good that has been delivered in several shipments, then the period runs from your receipt of the last good or shipment. After receiving them, you must only handle the goods in a manner allowing you to establish the type of good, its properties and manner in which it functions. For some goods there is no right of withdrawal. You can also lose your right of withdrawal. If there are goods for which the withdrawal right does not apply, we will state so in the order confirmation, for example due to the nature of the good, or how you could forfeit your withdrawal right by breaking seals. In order to exercise the right of withdrawal, you must notify us in an unambiguous declaration of such at the latest 14 days after receiving the good.

When returning goods, you must make sure that the goods are properly packed. You are, in fact, responsible for the package/goods until we receive them. So keep your receipt from the post office as well as any possible track and trace number. When you withdraw, you yourself must pay the expenses for returning the goods. For logistical reasons, Embacco does not offer a traditional exchange service as in a store You must attach a copy of the order confirmation or other documentation for your purchase. In addition, it would
ease our processing if you enclosed a filled-in return form, which you can acquire by contacting Service@Embacco.dk
When we receive your shipment, we will check it, and you will be paid back the amount you paid to us for the purchase. You can lose the amount of your purchase, in full or in part. This happens because the value of the good has deteriorated, because you have actually used the item, it has been damaged while you were responsible for it, you handled the items in a manner other than what was necessary in order to establish the type of good, its properties and manner in which it functions, you have not followed the limitations in the right of withdrawal that follow from the seals, type of good.
7. COMPLAINTS – IF THERE IS SOMETHING WRONG WITH THE GOOD (2 YEARS)
Your purchase is encompassed by the Danish Sale of Goods Act, including its rules for deficiencies. This means that you can either have a defective item repaired, replaced, your money returned or a discount applied to the price, all depending upon the specific situation involved.
It is of course a requirement that the complaint be justified, and that the deficiency did not arise in consequence of erroneous use of the product or other damaging behavior. You must contact us within a ‘reasonable period of time’ You must make your claim within a “reasonable period” after you have discovered the defect. We recommend that you claim as soon as possible and within 2 months of the defect being discovered. You can claim by contacting us via email at Service@embacco.com or by telephone at (+45) 7022 8025.
So that we can assess your claim, we will ask you the following:
1. Send us a brief description of how the damage or defect occurred. Please note that you should contact us as soon as you discover the defect.
2. To document the defect you must send 1-2 photos together with the description. The defect must be clear from at least one of the photos.
3. Send the photos via email to Service@Embacco.dk
4. Please indicate the order number for the item, or attach a copy of the order confirmation /receipt
5. After we receive your photos, we will deal with your claim as soon as possible. If you are returning faulty item(s), please send the items to:

Note: packages cannot be delivered in person at this address If the complaint is justified, we will of course refund your reasonable freight costs of sending the item back to us. If not, then you yourself must defray all expenses for transport, including our freight costs for returning the item to you
after examining it.

The above data will be saved with information on the specific goods you purchased for five years from the end of the accounting year the information concerns, cf. section 10 of the Danish Bookkeeping Act, after which the information will be deleted.
Information is not shared with or sold to third parties, unless such occurs in connection with a restructuring or a sale in full or in part of the company. Any possible sharing in such a situation will occur in accordance with the applicable legislation concerning personal data protection in effect at the time.
9. COOKIES
By using www.Embacco.dk you are accepting that we use cookies. A cookie is a small data file that we place on your computer in order to be able to keep track of what happens during your visit and in order to be able to recognize the computer. 10. CHOICE OF LAW AND VENUE
Purchases of goods at www.Embacco.dk are subject to Danish law. Any dispute will be resolved by the ordinary Danish courts.
